Can CPS Make the Father Leave with No Paperwork
My question involves child abuse or neglect in the State of: Texas
Cps got an anonymous call on my family for fighting. Caseworker interviewed my kids at school then contacted me said she didn't want the dad at the house and wanted kids to have forensic interviews. We complied, before interviews she told me that they had "indicators" of possible sexual abuse (which is completely false). After the kids interviews she never mentioned the abuse, said the fighting needs to stop and asked if we would go to counseling. Gave me a business card for a family center and told me to call them for services. I never signed ANYTHING with her. She told me that the father cannot come home until we get help. He can't even drive us anywhere (I can't drive). But again nothing was on paper saying these things and nothing was signed. It's been almost 3 weeks and I have heard nothing from her and neither has my husband. What should we do? The kids and I want him back home.

CPS cannot order him (or you, for that matter) to do anything - only a court can do that. What they can do however is make your life very difficult if they think there's something going on and you don't do what they tell you to do.

You need to get your drivers license. CPS can remove the children if they believe they are in danger. You and your husband need to get the counseling before CPS takes the kids.

What about the fact that we haven't heard ANYTHING for almost 3 weeks now? Is there a certain amount of time, like an expiration date, for all this? We have a lawyer we've talked to and he said to wait 30 days from the day she said for him to leave. Should I call cps? Or just wait it out?

Call CPS. Or wait. Or follow the attorney's advice.

If CPS gets more comlaints and you and your husband have not goten counseling, it is possible that CPS will remove the children. In order for you to get them back, if you are ordered to go to counceling, that is what you will have to do. And they won't be returned just because ypu say you will get counseling or because you start counseling. You may lso have to attend parenting classes and do other things. I don't see why you and your husband are so resistent to counseing if it could prevent the removal of the children in the future. It is doubtful that they will recommend counseling, if they are called again, they will remove the children and you will have to deal with the courts to get them back.
In other words, you are taking a chance on losing your children if you and your husband don't get the counseling and stop the fighting. The person that called CPS will more than likely call them again when the fighting starts up. You can do what you want to do. But, it will be easier to get counseling now than it wil be have to deal with the courts to get your children back, if they are removed.

We are in counseling and will be going to parenting classes. My question is due to the lack of documents and paperwork does he still need to be away from the home after 3 weeks? We're doing the things she asked us to do... Like counseling, he's been twice now and the kids and I have gone once so far. And there's a parenting class coming up. That's all she said... She didn't really direct us. I asked what do we do next (the last time I spoke/saw her) and all she said was "I guess you need to call that number and see what they can do for you. I don't work there."

I must have missed where you said you and he were in counseling and parenting classes. It is good that you and he are trying to correct the problems before they get worse.

You seem to know what's going on... So let me ask this: is there a time frame that they work with? I'm under the impression that they do a "plan" that we all agree to and sign off on for us to work on... When would this come into play? When should I expect something? And what if I never hear from them? Then what? I just hate the unknown.
