    Exchanging an Item for a Replacement at Clearance Price
    My question involves criminal law for the state of: Louisiana

    I bought an item at local chain for the MSRP then went to a different store from the same chain where the item was marked down for clearance. I then exchanged the item for the lower price. Would this be considered retail/return fraud? The item was purchased and exchanged with receipt.

    So the second outlet knew you'd just purchased the item for a higher price at the first outlet, and knowing that, the second outlet let you exchange the item and gave you a refund for the difference between the two outlets' prices? If the second outlet knew all this, then no, you haven't committed fraud.

    Just curious, why did you go to all this bother? Why didn't you just go straight to the second outlet?

    It was sold out at the second store. I showed them both receipts and did not hide the fact in any way.

    Also the item was exactly the same.

    This doesn't make sense. You said you exchanged the item at the second outlet - how could you have done that when the item was sold out at the second outlet? Or did you exchange it for a different item?

    And what "both" receipts? If you purchased the item at the first outlet, then you would have had only one receipt to show to the second outlet. And you wouldn't have bothered showing the one receipt you had to the second outlet, because the item was sold out there.

    Again, your story doesn't make sense. It made a little bit of sense in your first post, but then stopped making any sense in your second post.

    Sorry I meant the one receipt. I told them I bought it but I saw they had it marked down for a cheaper price. I showed them the receipt for the product that showed original price. They then did an exchange in order to give me the price difference.

    I brought the item in with me to the other store. It was still in their system but sold out.

    I call that a sharp-eyed customer. I'd have never thought to ask the second store if they'd honor the price. Well done!

    Many stores have a policy against this kind of thing since it cuts into their $$$$ but enforcement is often lax to say the least.
