Getting Custody of a Child Through a CPS Placement
My question involves a child custody case from the State of: Texas
I live in Texas and my cousin has an open CPS case against her due to her and her husband testing positive for meth while the baby was in their care. Her 5 month old daughter has been living with me for a month solid. CPS is in the process of placing her with us but not as a kinship more as mom agrees the baby stays with us. The cps worker is suggesting we get temporary custody is this a good idea

A CPS worker is not an attorney. Is it a good idea? That is NOT a legal question. Temporary custody is more stable than being placement. However, if you get temporary custody, you may be responsible for supervising visits between the child and her parents.

I'm already supervising the visits with her parents. We talked to the caseworker and they are going to do placement for another 90 days at most then they are dropping the case. Is there any way I can file for custody of this baby before this happens?

I live in Kentucky, and here, in order to keep the children in our home, we had to file an order for temporary custody because, otherwise, family court could have decided to give the children back to their biological mom at any time.

With temporary custody, the child can be returned to their parent. BIOLOGICAL mom? Really? Please don't post gavinsmom if you do not understand the legal terminology. You need to speak to an attorney Amber422.

"Biological" implies there is also an adoptive (legal) mother. If no adoption has taken place, it's just "mother".

I suppose it makes sense legally, then. Just not emotionally for the party involved her (ie: me).

A Foster parent or other temporary caregiver should always work hard on emotionally accepting that one day the child will likely return to the actual parent(s).
