Getting Emancipated Without a Job or Income
Hello, my name is Alex, I'm 17 years old turning 18 in 3 months. I have an issue that I'd like to address. I've done the research of emancipation in Wisconsin and nothing says that I cant be emancipated besides one fact, and that would be that I don't have a job. Me and my dad got to talking today and he got upset that I want to move out.. I talked to my friend about emancipation because she has lawyers as family and she said that emancipation can occur at any reasonable age in wisconsin if you meet certain requirements, I meet 2 of those requirements but I guess my question would be, if I graduate high school in 2 weeks and I have a household that has a steady income and would be stable for me to live in.. Would I be able to be emancipated to go live there? The requirements are simple, be able to be responsible with an income ( which is my problem because I don't have a job, I live 10 miles from the nearest town and I have no license or transportation .) be a mature adult, and have a good living enviornment. Ill say it again.. I live in the middle of nowhere but if I get emancipated I will be living in Milwaukee (my hometown ) with a mature adult that has a steady job, home , and life. But I guess my point is my dad doesn't think I'm capible of living with the responsibilities of an adult... Yet he hasn't let me try
Re: Emancipation for Minors
No. Emancipation means that you are supporting YOURSELF, not that someone else is supporting you. If you cannot pay every cent of what it takes to support yourself, then you cannot be emancipated, no matter how stable the household that would be paying for you.
Besides, if you are turning 18 in three months, you couldn't get a petition heard before your 18th birthday anyway.
Re: Getting Emancipated Without a Job or Income
The basic idea of emancipation is that you are able to be self-supporting, i.e. able to live independently on your own without the need for assistance from others, including the state. You would not be self-supporting. You don’t have a job and would be relying on others to support to you: provide you a place to live, food, etc. Under those circumstances there is no way that a court would approve a petition for emancipation. Besides, it is very unlikely the petition could be heard and resolved within three months and it would cost you a lot to litigate it.
All you have to do is wait three months, turn 18, and then you are free to move in with friends or whatever else you want to do. Three months is no time at all. So sit tight for the three months and then if you still want to move out, go for it after your turn 18.
