How to Get a Domestic Violence No Contact Order Lifted
My question involves criminal law for the state of: Ohio
i rent my home on a month to month lease. i currently have all bills in my name.my brother rents a room in the house from me not on a lease.he had the gas bill in his name as his only bill he relapsed on drugs and got in legal trouble and got the gas turned off without telling me this was happening.i then told him i would not put up with drugs, failure to pay bills etc in my house and told him he would have to move out.he took his jacket off balled up his fists cursing my girlfriend and i out and flinches at me.i then punched him first in the side of the head one time leaving a small cut on his ear. i backed off sat down and waited on the police, explained the situation to them.they tried to talk him out of pressing charges and he refused laughing saying its his house now.it was a friday so i spent the weekend in jail on a domestic violence charge and was released on bond .they gave me a no contact order and he is currently living in my house paying nothing at all while i am paying all utilities and rent. i am afraid he will rob me blind being on drugs and vindictive i cant trust him in my home.my girlfriend isnt staying there either for her safety.this is draining me financially costing thousands.i am at a loss with what to do.please help
Re: How to Get a No Contact Order Lifted
As you are charged with a crime, you should retain a criminal defense lawyer to represent you. Your lawyer can discuss the charges, and the need for the protective order, with the prosecuting attorney on Monday. Given that it will not be possible to discuss the matter with the prosecutor yourself without making statements about the events to the prosecutor, who is also responsible for trying to convict you of the criminal charge, I would not suggest trying to have that discussion directly as opposed to working with a lawyer.
