Ticketed After Looking at a Cell Phone While Driving
I also just got a ticket for looking at my phone yesterday. I was on freeway in stopped traffic and my gps did this thing where it locates a faster route and automatically reroutes unless you click the dismiss button so annoying so i was hitting the dismiss button and i get pulled over. I wasnt moving on freeway very much but he wrote me a ticket foe unsafe speed while driving and put (using both hands cell phone) and then in speed put 20mph. And he tried explaining to me that all speed is unsafe while using cell phone so he had to put it as that. So then its no longer just a cell phone ticket? Its now considered a speeding moving violation? Is there any way to fight this? For it to just be a cell phone ticket and not a speeding ticket? I just drive alot for work so my insurance is already really expensive just need help if any possible way to fight this? Thanks

Re: Ticketed After Looking at a Cell Phone While Driving
As is discussed in other threads, many jurisdictions are issuing unsafe speed tickets for cell phone use rather than trying to prove that the person using the cell phone was actually talking on the phone, and not using it as a GPS or for some other use not forbidden under the statute forbidding the use of a cellular phone while driving. I can't promise you how a local judge will respond to your defense that you weren't moving very quickly.
