First Degree Criminal Tresspass
My question involves criminal law for the state of: Colorado
To make a long story short I got scared of noises I heard and ran Into an empty house and his in closet cause my car wouldn't start. I have no prior history this is my first offense ever! I don't do drugs, smoke drink nothing. What do you think is gonna happen
Re: First Degree Criminal Tresspass
If you are charged, you need an attorney big time. This is a FELONY. This has extremely severe implications, three years in jail and $100,000 fine is the maximum for this.
Re: First Degree Criminal Tresspass
That's if I don't accept a plea right?

No way to know what will happen. I don’t know all the facts of the case, and particularly what evidence the state has against you. The state must prove that you knowingly and unlawfully entered the dwelling of another in order to win conviction on a first degree trespassing charge. That won’t be too hard to do if they caught you in a building that was obviously a home and you had no consent to be there. This is a class 5 felony, so jail/prison time is certainly a possibility if you are convicted. Because this is definitely a serious offense, you really should get a good lawyer to represent you. Maybe you can get a plea deal down to some misdemeanor charge or otherwise lessen the severity of this, but your chances to that are much better if you have an attorney.
