    Are Recorded Phone Conversation Admissible in Court
    My question involves criminal law for the state of: nyc

    my Fiance recorded our conversation without my knowledge is such things even admissable in Court. She was in nyc at the time and I was in Florida. Thanks in advance

    What is the relevance of the recordings to the criminal case against you? Do you confess to domestic violence?

    New York is a one-party consent state. If she knew you were in Florida, you are fee to make a police report in Florida and see if they have any interest in the matter (I doubt that they will), but that won't affect the legality or admissiblity of the recording in a New York court.

    Yeah I told her she could keep the 15,000 diamond ring- cause shes marrying somebody else! i since changed my mind. i need it for lawyer costs.

    Read the following webpage by a NY attorney:

    While you would normally get the ring back under NY law (you would have to sue her there), that you told her on the phone that she could keep it might have turned it into an unconditional gift.

    NY small claims limit is $5000 so you would need to sue in a higher court for a $15,000 ring and you're likely to need a lawyer to get that done right.

    You battered her, you are being criminally prosecuted, and you want to take a gift back -- a gift your confirmed as unconditional after you broke up -- so you can sell it and pay your lawyer? Good luck with that....

    You posted this thread in a forum for criminal charges, and chose its subject as domestic violence. If you post inaccurate information, it's nobody's fault but your own when other people rely on it.
