My Girlfriend's Parents Want to Keep Me Away from Her
I live in Wisconsin and I have been dating my girlfriend for almost a year and her parents recently found out that I have been having sex with their daughter. I am 17 and she is 16 they want to put a restraining order on me and told me they will put criminal charges on me for having sex with a minor but I am still 17 about to be 18 in 6 months will that effect me? Can they put a restraining order on me if I didn't do anything illegal? If they were to put a restraining order on me would I be sent to jail for still contacting their daughter?

The state law includes no "Romeo and Juliet" exception and, although most discussion relates to charges being leveled against adults, I see nothing that suggests that you could not be charged under the statute. The violation of that statute would create a basis for the child's parents to seek a child abuse restraining order against you. One possible consequence of violating a restraining order, should one be issued, is incarceration.

Of course the problem for the parents of your girlfriend is that as § 948.09 is written your girlfriend has also violated that law. That means that both of you could be prosecuted for the offense. The difference between you and her is that because you are 17 the state would prosecute you as an adult as a 17 year-old is considered an adult for purposes of criminal prosecution. Your girlfriend would be prosecuted as a juvenile. The parents might be willing to risk that to see you prosecuted as an adult on a sex crime if they are mad enough at you for failing to stay away from her after they’ve told you not to have contact with her. Do you really want to risk that?
Your girlfriend’s parents control what she does and with whom she hangs out until she reaches age 18. If they want you to stay away they have the authority to enforce it. If you don’t stay away from her they can get a court order forcing you to stay away. And if you violate the order you might end up spending some time in jail.
The bottom line here is that the smart thing to do if her parents want you to stay away from her is to do just that. Don’t let your teen hormones and emotions lead you to do something stupid.

Once again, an example of how desperately we need this as part of the sex ed of every teenager, male and female, and as I say, there's NOTHING in our culture that's teaching these kids the law. OP, stay away from this girl if her parents want you to stay away from her. I know you think this is the great love of your life and that you cannot possibly live until she is 18 without being in a relationship with her. But from the other end, when you are 50 you probably will not even remember her name. Unless she has ruined your life, and you have spent your adult years with your picture on the internet as a child sex predator, and you can't get a professional job and you are haunted by this forever.
Move on. Her parents have all the power, and believe me, when they start pulling the financial strings, her love for you will grow colder anyway. She'd rather have her cell phone, her transportation, her disposable income, and these are things they could take away from her as well as ruining you, which they'd be happy to do if you cross them. Go away, just go away.

That's the whole idea of a restraining order. Violate it, go to jail, go directly to jail. Do not pass go. Do not collect $200.
I echo the advice of others. Give up on this girl and move on.
