Do You Owe More Child Support if You Win Money
My question involves a child custody case from the State of: Georgia
i won money......mid 6 figures. can anyone tell me what happens to my child support situation next? i know the irs will be contacted. does the irs automatically contact child support? will child support be told how i came across the money? will this money automatically re-calculate my payments?
Re: Do You Owe More Child Support if You Win Money
There's nothing automatic about anything.
Your ex will have to file for a modification based on a substantial change in circumstances.
If you have any arrears I suggest you pay them in full, immediately,
Re: Do You Owe More Child Support if You Win Money
oh ok. thank you. do you know if the court requires me to reveal how i came across this money?
Re: Do You Owe More Child Support if You Win Money
If your Ex goes back to court for a change in circumstances and modification, you can bet on it.
Re: Do You Owe More Child Support if You Win Money
oh ok. for clarification, would the court modify based on the amount i received? by this i mean, i have sum bills that i want to pay off.......bills from my surgery, student loan, pay off a few credit cards and i want to buy my son 2 more mutual funds as well as put sum money in the bank for him. do you think the court will take this into consideration at all or just calculate based off the total i received?

I'm guessing that the court would want to verify the source and the amount.

You might be allowed some deductions for your own bills and debts but giving away any of the money is not going to be allowed.
Example (and I'm just guessing here):
If you won $500,000 and spend $100,000 on your bills and debts, that might be allowable deductions.
But if you then give your son $250,000 your CS is likely to be calculated on the $400,000.
Or maybe the whole $500,000.
You know what. You've got money in the mid 6 figures. Spend a little on a lawyer to properly advise you.
Re: Do You Owe More Child Support if You Win Money
The Georgia Code includes prizes and lottery winnings in gross income for purposes of determining child support, O.C.G.A. § 19-6-15(f)(1)(A).
If you want to work out an agreement with the other parent whereby some portion of the amount you end up paying as child support ends up in a savings account for the child, I suggest speaking with the other parent. If you act unilaterally, you should expect that the court will regard the money as a gift you have made to the child, and not give you any credit for that amount when setting your child support obligation.

As of two months ago there was no court ordered child support.

I wonder what's happened since then.

Cam Newton is asking himself that very question.
