Can Malpractice Actions with Different Plaintiffs be Filed Together
My question involves malpractice in the state of: California
A family member and I had the same doctors almost down to the very last one. A lawyer has already taken their case. I wanted to know If I should file with them or apart from them. This being my father and I, I figure it would be a strong case if we did it together. Or if we should just file apart from each other. If more so, he has a stronger case if he went alone than I do. Or so I think because they truly messed up in his case big time that couldn't be hidden very well.
To file together or not together that is the question

Did you and your father have the exact same procedure/treatment? Did you both suffer some kind/the same kind of adverse outcome? Did you both have the exact same doctors cause if not, you can't both be suing each others doctors. Have you spoken to a med mal attorney to have your specific case reviewed individually?

we both had the same two doctors. Both doctors made mistakes. His is far different from mine. I have no spoken to a med mal attorney yet. We were both affect by what happen to him but he is the one who took the pain from it. I took the ptsd from it. we also were not getting the blood test we needed. for the most part, we are two different cases I believe. Would it be better just to talk to his lawyer about my case individually? or should I have a completely different lawyer to talk to?

You can speak to your lawyer about filing at the same time, but it would be a separate lawsuit.
