    Can You Break Your Lease Due to Noisy Neighbors
    My question involves landlord-tenant law in the State of: North Carolina

    I live in a townhouse style apartment. I have been here 8 months. About three months ago neighbors moved in that have made it hard to live here. They fight all the time, they have a baby that literally cries for hours. They scream at the baby, they threaten it and call it names. They fight with one another and threaten each other. They run out of the apartment screaming. I have recorded them on two occasions that they were fighting outside. I have reported it to management over and over, they claim they have talked with them about it but it has not stopped. I have had the police there about three times and the police talk to them and it continues. I have to deal,with breathing in marijuana and cigarette smoke. The other day the female threatened my son, he is 19. She said to him "if you call the police one more time, you will be sorry". He ignored her.
    I reported this to management and they don't believe us. They told me to call the police if it's true. I will not call the police as now I am worried about them hurting us. You are supposed to be background checked but I found out she has an assault with deadly weapon charge, and drug charges. Though they were about three years ago,when she was a minor. But that makes me very afraid. When I come home she stands on her porch and "stares me down". I am a handicapped woman in my 50s and am very afraid for my life and my children's lives.
    I have contacted an attorney and he charges 200 for a consultation and of course cannot say if I will be able to break the lease.

    Do you think I have enough evidence to be able to legally break the lease with an attorneys help?

    You can ALWAYS break the lease. Nobody is going to make you live there. Now if the landlord wants to pursue damages for that breach or refuse to return the security deposit, then that is another story. I assume you've made your prior complaints in writing at some point? If not you should do so now.

    Every complaint was done through email so that I have proof. And of course I can break the lease, I meant without being charged.

    How big is the complex? Is there a possibility that the landlord will allow you to change units?
