    Threatened With a Statutory Rape Charge
    My question involves criminal law for the state of:

    I have had a long time girlfriend that I met online. Tonight I was a little worried about her after not speaking for a bit, and came across her Facebook page. I found out about another guy, and spoke to him. Everything was a lie, etc, etc.

    Onto the legal issue. So... I spoke to him, when she would not answer. We talked, I showed him evidence of our relationship, all that jazz. He spoke with her, and she claimed to have called the cops and been pressing charges. As soon as this was said, I backed off and said I would never speak to her again.

    While I doubt she has actually pressed charges, it does put a bit of an edge in my mind. Any idea how long it might take for me to be notified of any crime I may have committed? Or even if this was considered a crime? All I can possibly think of is harassment, but I backed off immediately when asked.

    We need to know where you're located.

    But from what you've said, all you have is unfortunately typical Facebook drama - no crime. Pressing charges for ... what, exactly? Finding out you've been lied to isn't a crime. Don't worry yourself.

    The only other possible crime is our half year age difference. I'm 18 and she's 17. But we haven't done anything sexual so I don't think it's illegal?

    Also, we met when we were both sixteen. Which I believe goes into the Romeo and Juliet law.

    Also, according to her state law, 17 is legal too. I think. Not 100% sure.

    Gahh, this is why I never do this shit, lol.

    In New York the age of consent for sex is 17. Moreover, even if you had engaged in sex with her when she was 16 you would not face any criminal charges because you are less than 4 years older than she is. Thus, so long as she agreed to the sex you would not be facing any criminal charges here. And since you say you never had sex with her that’s all just moot anyway.

    If you actually harassed her you might face criminal charges over that, but criminal harassment takes a bit more than one or two unwanted communications. Presumably she agreed to participate in most of your communications so that shouldn’t be much of a problem either.

    If either of you sent photos/videos of yourselves nude or in sexually suggestive situations there is a potential for either or both of you to face criminal child porn charges. That would be very serious.

    Apart from that, what it appears is that this is basic teen drama. She got caught in something that ended up embarrassing her and she’s trying to cover herself now by claiming to her boyfriend that you were harassing her, etc. This sort of teen stuff happens every day and the police won’t be in the least bit interested in sorting out that kind of drama.

    Thank you to both of you. Just a little nerve wracking because I've been dealing with trying to hunt down a job for quite some time and this would kill any chance.
