    Establishing Your Husband as the Father After Signing an Affidavit of Nonpaternity
    My husband is not the father of my recently born baby 10 days old, we are still a family intact. We do have a four year old daughter. My husband wishes to be on the birth certificate, but i signed an affidavit at hospital stating my husband was not the father. There is no father listed on birth certificate, will i be able to get my husbands name on birth certificate? And what is the process?

    That aside, you've already signed a document stating that your husband is not the father. Are you now wishing to change your mind? Where is the biological father?

    And more importantly are you willing to lie to state he is the biological father? The biological father may very well be able to petition for custody/visitation. Or are you planning on just lying to your child about who her father is when she starts to recognize people?

    We live in pennsylvania. My husband and i were seperated for a short time. I made a mistake. The father of child is not present. My husband wants to be fully responsible for this child, and wants our family to remain as a whole. He will be the only father she knows. I will tell her the truth someday. I didnt realize i didnt have to sign the affidavit, i sign before really thinking, especially since in PA husband is presumed the father. Anyway my question is can or will i be able to get him on birth certificate?

    I just want to know if there is a way to get my husband on birth certificate, it is what we both want.

    Talk to a lawyer. You've signed a legal document stating that your husband is NOT the father. Time to lawyer up and see what happens.

    I need to stop being so quick to signing papers without really understanding them, this isnt the first time, this is just a much bigger thing.

    Your choice at this point may be stepparent adoption. You should consult a lawyer with the full facts.

    You were separated from your husband. You became pregnant by somebody else, and had the baby. You signed a document acknowledging those facts. What is it that you didn't understand?

    Why has your husband changed his mind about being the child's legal father in the @week since you and he signed the affidavit of denial of paternity?

    My husband and i were seperated at the time of conception, we were together the last five months of pregnancy and now. I didnt read the paper thats the issue, it asked who my husband was and his address, i filled in and signed. My husband has not signed any documents, so no he has not signed affidavit of non paternity.

    I learned that i signed such document after calling hospital asking when birth certificate is to arrive.

    Like i said my husband never signed anything, he was there for the delivery etc and it was his understanding he would automatically be on birth certificate. Which normally he would, but im obviously not that bright.

    What did your attorney say about all this?
