Will a Store Catch a Shoplifter With Face Recognition Software
My question involves criminal law for the state of: California

Hello. I have a question...unfortunately one of my children made a huge mistake and stole an item from a local Walmart that uses facial recognition cameras. While he was not stopped leaving the store, my husband and I caught him w the item and he was busted! As a family our rules are that the first a "mistake" is made we handle it as a family and the punishment is chosen based on the nature and type of said "mistake". After that depending on the situation, but this being a theft(whether from a personal person or store) if caught by my husband and I, or others A second time, it is known we WILL go to cops ect..that being said more serious offense...(murder, or harmful behavior...of any type) ALWAYS gets reported!
    This is my question.....
Can he be caught walking in w me or my husband...grandma ect.. months later and be charged? What if he never goes back to that Walmart? Are they all connected w data ??! I mean we are prepared to ban him from Walmart all together( which its one of the only larger retailers in our area) but til he is 18... He will be punished if he goes back to the point of telling the LP if I have to get an official ban
He don't comply....I am scared that grandma is going to take him shopping and get stopped for it or something of that nature??! I'm freaking out man! As a mother of 5 I have have a VERY tight reign on my boys...but this younger one seems to be a bit more difficult ..I am often known as the "mean mama" around town :/ but w 5 boys and crap like this I gotta be! UGH! I just don't want us to be in there and get stopped for it ...ESP w grandma. :/ any advise is helpful! Thanks

    Re: Consequences of Shoplifting
I'm not sure what you are asking. If you are indicating that your husband caught your child shoplifting, and made him return the item but the store did not notice and did nothing, then odds are that nothing more is going to happen. If you are indicating that the store caught your child shoplifting, and didn't prosecute but issued a chain-wide trespass ban, then he takes the risk of being charged with trespass if he goes into any store in the chain. You need to provide the relevant facts.

    Re: Consequences of Shoplifting
Some report the system was only use in a limited area and was only a test program. Others claim it is currently being used in in stores. The truth is something only Walmart can say but I strongly suspect they have employed the service but have no idea how widespread it is.

Due to that, if they are currently using it and if he was seen on camera it would be possible for any store using the system to identify him. They surely would not limit its use to an individual store but interconnect any store using the system.

You can take it from there to guess what could happen should be walk into a Walmart.
