    My question involves marriage law for the State of: i am 23 my gf is 17 i was trying to get more info on how to go about marring my gf to get her emancipated from her parents i want to do it the right way

    You need to answer the question Vinnie. What state are you in?

    Understand despite what you think you learned in middle school social studies class, emancipation is not a way to escape parental enslavement. It is recognition that an independently living minor needs relief from certain things prohibited them by their age (such as the ability to enter into contracts).

    I'm going to take a wild stab in the dark and say Ohio.

    It im correct, the right way is either get her parents permission or wait until she is 18.

    Yeah, if you do a little social media sleuthing, you could come up with that answer.

    In Ohio (and most any other state I can think of), she will have to have her parent's consent to marry under 18, anyhow, which is likely to be even more of a problem than getting their permission to just move out. There's no emancipation at all in Ohio. Entering the military or getting married will allow you to live away from parents. But again, you can't marry or enter the military under 18 without parental consent.

    I said this earlier today. I will say it again now in more detail.

    In no state can a minor be married without parental permission, permission from the court, or both. In some states if the parents say no, it's no and there is no appeal. In some states if the parents say no, the state *might* have the discretion to issue a marriage license anyway with judicial approval. And in some states, depending on the age of the minor, permission of the parents AND judicial permission may be required.

    Few if any judicial bodies will grant permission for a minor to be married in defiance of her parents' wishes.

    So the answer to your question is, you don't. You wait till she's 18.

    In Ohio, there's no court option. The court only gets involved to appoint a responsible adult if the parents are not alive or otherwise competent.
