    What to Do if the Other Parent Takes Your Child Off of Medicaid
    If the mother of my child took him off Medicaid and he has current monthly doctors appointments how do I put him on Medicaid under me? Will this change our current child support arrangement?

    You have failed to identify your state, and you have also not shared any relevant facts about the custody order or why your ex- would take a child off of Medicaid. (It also seems a bit odd that you are talking about the mother of your child when you call yourself "Stepmomof1".)

    The custody order should explain who is responsible for providing health insurance for the child and under what circumstances. If the child is not insured, then look to the judgment to determine your respective responsibilities. If you are able to enroll the child in Medicaid as a joint custodian, then you should speak to a case worker about enrolling the child -- but we cannot really comment on your situation without the relevant facts.

    A non-custodial parent may not enroll a child in Medicaid. Medicaid eligibility depends on the economic status of the custodial parent.

    In addition, no parent willingly takes a child off Medicaid if they qualify.

    What is likely going on here is that the custodial parent no longer qualifies for Medicaid, and therefore the state is looking to the non custodial parent to provide health insurance. The non custodial parent might want to look into insuring the child under Obamacare.

    Well if you want the long story:
    My stepson is 5, he has a brother that is 7. My husband and I have full custody and I talk to the other boys stepmom in hopes that they will one day also have full custody of the 7 year old.
    I was asking on behalf of the other father--so I should have went into detail but I was typing in a hurry and unable to explain everything.

    From what we've been told, the mother is not employeed and pregnant with baby #3. The oldest boy has spacers for his molars that need resizing multiple times a year and has recently broken his arm with his mother not being able to show proof of him being covered since July of this year in Medicaid.
    His father thinks the state (Texas) will make him pay more if they see she is unemployed when he goes to file the boy under him.
    The mother has mental and drug problems and currently lives with her mother which is one of many reason why the 5 year old is under visitation with his mother. I don't know anything about Medicaid because we are covered under a private provider.

    We are just trying to figure out why he would be taken off and if this will change their current custody and CS arrangement.

    Child support in TX is based solely on the NCP's income therefore mom's unemployment is irrelevant. If mom is unemployed and pregnant then she is almost certainly on Medicaid, therefore any child in her custody would be on Medicaid as well.

    You are a third party to this case getting your information from another third party. That is an excellent recipe for inaccuracy.

    And I'm telling you she's not due to the fact that she just didn't re-enroll.
    I understand I am 3rd party. All I've done is google searches and found this site. I'm not taking any of this information to a court or an AG I'm just trying to help just as the other party is also trying to get help and information as well.

    Are you stating that dad is the primary custodian? Then it would make sense for dad, as the primary custodian, to get insurance for the child, be it Medicaid (if he's eligible) or something else.

    I did not catch that dad is the primary custodian of the child. In that case mom CANNOT enroll the child in Medicaid, only dad can.

    The 5 year old is covered under our insurance because my husband has primary. The 7 year old is suppose to covered by his mother the primary.

    Maybe it's time for dad to seek primary custody of both kids.

    There are 2 different fathers. Technically three with baby on the way.

    Ok, this is the child that belongs to the other father whose wife you are talking to. Please do not ask questions here about that child anymore. Have the father of that child register himself to ask his questions.

    Also, please do not post in the first person for questions about someone else's case.
