Should You Abandon or Demolish a Mobile Home You Cannot Sell
My question involves personal property located in the State of: PA. I have a double wide mobile home in a park I was trying to sell. I had no buyers at all so I decided to give it away for $0 nothing and avoid going broke paying the lot rent. I had many people show up and they were all refused or denied applications from the park manager who has a vendetta against me. The landlord has a history of getting the old trailers back and reselling them for $8500 and the park manager likes to bully harass and intimidate people so that this more likely to happen. The landlord expects to get back them back fully painted and taxes paid years in advance also. She is so controlling she gets to control what color you even paint the trailers.
A few nights ago two buyers were looking at the trailer the manager storms over in a hostile rage and accosted my mother and told her she would not accept any applicants and that my trailer had holes in the floors and smelled like shit and it needs torn down. Just a few minutes earlier I get a phone call that says "i seem like a slightly intelligent person" from this lunatic.
My mother had already spoke to the land lady earlier and told her she would demolish it after one buyer went to speak to the landlord about buying the home from me and she raised the rent $65 on the spot as well as told the buyer he had to paint the exterior fully before any sale could even be approved. This is to make it impossible for me to sell it but give it to them. the land lady said " don't care what you do". I believe she thought it was an idle comment by my mother.
Since I am trapped and forced to pay rent with no option to sell it ever and the only option is give it to them after they want me to invest my life savings into first I did what needed done.
I was approached on one of ads by a contractor who would demolish it for $500. I paid them and they arrived and it began about 40% done the park manager saw it going down and went psycho and called the police and code officers. The demolition was stopped and no fines were levied. The police seemed very understanding of the situation and let the contractors off the hook for no permits.
I now have a half demolished mobile left in the park. I believe it was stopped so they could try to salvage it as is so they can flip it. If I abandon it what can happen to me? Should I get a permit and try again? Paying for all of this is an issue also.

this is a personal issue and not a legal one
personally I would get the permit to finish demolishing the building and be done with it.
as far as what can happen to you; you can be charged for lot rent until it is removed or title is transferred to somebody else.
I surely would not make any repairs on the building and never would have. In fact I probably would have painted it the most God awful shades of pink, purple and green just for spite.
and those holes the landlord said were there; yep, there would surely be holes there once I got done with things.
but that is just me being spiteful. What I would suggest somebody else do that doesn't want to give it up to the landlord is get a permit to demolish it and get rid of the thing.

The title is in both my name and my mothers. If there a way to void the title? I saw a penndot form mv-16 but it is for the landlords use. If I put the title in my mothers name alone with a transfer would that protect me? She is financially judgement proof all they could get is her car. The permit might not even be approved you never know with this municipality and if the landlord has any sway with them.

in whose name is the lot lease? that is what is important here more than the title of the home. The owing of rent is based on the lessee of the lot, not the owner of the home.
but why would you hang your mother out to dry like that? The legal activities could be quite onerous.

as far as the municipality not issuing a permit:
there are ways to render the building to be in such a condition they wouldn't have an option but to issue a demo permit. I would reserve that for a means of last resort though. It has inherent problems that could cause you some issues, and money.

My mother is already on the title anyway. Dropping one of us off it won't protect either of us then.
The problem is these scumbags try to get you to sign updated lease agreements with new regulations every few months with a mailed form. Sign new terms of be evicted return to office. I normally shred these things but I may have signed one or so.

Why can't you just sign the title over to the landlord, in lieu of rent on the lease, and be done with it. Don't ask for an agreement, just do it and walk away.
Will she sue you for unpaid rent? Perhaps but she also has to mitigate her damages and you gave her the mobile home.

Well they are assholes so I expect a $500,000 lawsuit. The park manager already made threats that she is the wrong person to mess with she will destroy me. This park manager is a megalomaniac almost everyone that tries to leave this place has their life ruined or they leave bankrupt in total despair she makes sure of it. On the bright side She gets to look at it now in that condition though and its on record on file with the police she was harassing my family for years.
I put a brown classic car tarp on a car once until it needed towed for an insurance investigation we had a cussing and shouting match over it for 30 minutes in the parking lot because she could see the tarp from her view on her front porch and it offended her so much she went psycho.

You were willing to give the mobile home away for nothing so do it and be done with the problem.

I suspect it is simply the op cannot bring themselves to give it to the landlord even though they were willing to give it to just about anybody else. I can surely sympathize with the op's feelings on the matter. I have spent thousands due to spite. I enjoyed losing every penny of it.

I sympathize too. It sounds to me like the landlord is making money seizing people's mobile homes and then reselling them. Its actually a pretty common predatory situation. Its kind of along the lines of landlords who sell houses on "contract" so that they never have to make any repairs as landlords, but always find some way to take the house back.
I would spend the money to get the permits and completely demolish the home before letting her get her hands on it.

You can execute whatever documents you choose, but you cannot force somebody to accept title merely because you sign title over to them.

They do not seem to need need permits, and they usually get the cat out prior to the start of "remodeling".
I would never use or recommend them myself, but I have seen their work. :cool:
