Sending a Cease and Desist Letter for Defamation
My question involves defamation in the state of: ca
If an employee of an company makes false statements against you in a document (say memo) and circulate the documents within his company saying I sell fake merchandise. Then if it is not true I would have a case against the employee for libel. Rr do I???
But do I have a case if an company employee writes me a letter making false statements against me say I sell fake merchandise but a copy of letter is file within the company where a lot of people have access to it. Do I still have a libel case?
The reason I ask is that if a employee of a company writes me a letter making false statement. I have proof the statement is made I have the letter. I think it is also easy to proof the letter is filed and who has access to the files. Do I have enough legal ground to issue credible cease and desist letter. We are assuming the statement made is false and would cause damage.
p.s. I am not an employee of the company.
and if a cease and desist letter for libel is not appropriate would another type of cease and desist letter be better and if so which one.

A cease and desist order is useless outside of it perhaps persuading someone to stop saying or doing ... if they don't know any better, anyway.

yes, I understand that. However, if I really don't have a case or good legal theory then the cease and desist order would not be that credible. So I want to make sure my theory is sound or I have to figure out another way to get them to stop.
