Will the Police Prosecute a Domestic Violence Case You Previously Chose Not to Charge
My question involves criminal law for the state of: Texas
On 11/29/15 I was involved in an altercation with my husband it escalated and he ended up biting me and taking a huge chunk out of my arm and he also punched me several times leaving me with a black eye. Originally the day it happened the cops were called but we did not move forward in hopes to work it out but today 12/8/15, we got into another argument and he slapped me across the face several times. After that I chose to go to the police and file a report on both incidences. The officer took my statement and photos and said he would have to get in contact with my husband in order to get his side of the story.. My question is did I wait too long to go make a report since the officer said he would not be able to make an arrest. Im wondering what will be the next steps in this case, will it move forward or am I out of luck and he will remain free and no charges will be filed?

Can you translate that for us? The police were called, they came to the scene, and you told them that nothing happened or gave a false account of your injury?
Did you require medical treatment for the "huge chunk out of [your] arm"? If so, did you deny any domestic violence at the time of treatment? What did you describe as the cause of your injury?

Did you hide your injuries and provide a false statement? Because based on the quote above, it certainly sounds like you did. Cops will make an arrest, even if injuries aren't present and the victim verbally tells police they don't want to press charges. So for you to say he took a 'huge chunk' out of your arm AND gave you a black eye? Certainly sounds like you lied to the police, rather than 'deciding not to move forward' with it.

What you chose to do is entirely immaterial. When someone commits a criminal act it is society that is harmed at is the state that prosecutes (and determines whether they wish to do that or not).
