    Selling Stolen Gold to a Pawn Shop
    My question involves criminal law for the state of: Hawaii

    Couple questions for everyone,

    Can a transaction that involved stolen gold sold to a pawn shop with no receipt or proof of sale be traced by police?

    Can police investigate stolen gold solely on a persons word with no proof of ownership?

    Are you saying the pawn shop committed a crime by purchasing something with no record of the sale?

    gold like in an ingot?

    Witnesses may be adequate to prosecute the various crimes. It will depend on the totality of the facts at hand.

    Yes I am saying that stolen gold got purchased by gold buyers shop with no receipt given of the transaction to seller. No ID was checked , Cash was exchanged for gold.

    However there might be a video of transaction not positive though.

    As far as I know the gold in question was jewelry and coins.

    The supposed owner claims the gold is stolen, yet has no receipts or way to prove ownership.

    Witness claims to supposed owner he saw the person with the stolen gold and thinks he pawned it.

    Supposed owner wants to involve police and press charges.

    Can police investigate without proof of ownership from supposed owner and no proof of transaction at shop?

    Of course the police can investigate. Have you thought of descriptions of the jewelry (perhaps pictures) and the type and year of the coins?

    What is the dollar value of the stolen property and who are you in this?

    Usually, absent a specific value of the item, the gold is melted down and thus is not identifiable.

    Thank you all for the responses, much appreciated.
    I am a concerned family member related to those involved.

    From what I understand the appraised value paid was less than $300. It was a coin and a small pendant.

    This happened weeks ago and no family member has yet notified police, however one side is threatening to involve police and press charges unless other side returns property.

    How long does a shop hold on to gold before melting down?

    The only way you would be in a position to state, as fact, the information you have provided is if you were the thief or the thief's accomplice for purpose of the sale. If that's not the case, perhaps you should have the thief post as the "facts" he's given to you may be incomplete or false.

    If you want to know if the pawn shop still has the item that you sold to it, go to the pawn shop and ask if they have it and if they'll sell it back to you. If they still have it, buy it back, return it, and if you're lucky you'll be done with the matter.

    If the pawn shop / secondhand dealer was obeying the law, the store has a record of your name, address, date of birth, the date of the transaction, a description of the item, an estimate of the weight and value of the gold, the price paid, and your signature.
