What to Do if Your Ex- Won't Give You Permission to Take the Child Overseas
Hello everyone,
I need to travel to another country for personal reasons and I want my 7-month-old baby to come with me. I am married, but my husband and I are not in good terms right now, so he's been telling me that if I want to travel abroad, he will not give me written permission to bring the baby with me. I plan on travelling for a month, but with my baby. I live in the States. My question is the following, should he become relunctant to give me the authorization, can I come to the judge and ask him for permission to do so? Thank you!

You better have a courts permission, otherwise, you will likely find parental kidnapping charges against you. Expect hubby to ask the court to require you post a bond between $10k and $30k to assure the child's return if they grant permission.

They're married. She has the right to leave the country with the child. The only limitations would be the airline itself who might have their own requirements and the passport office.

A parent cannot kidnap their child if there are no custody orders and they are still married.

What if I commit myself before the judge to returning after having visited my family overseas? I guess I can only be accused of kidnapping if I donīt come back after the one-month period, or can it still be the case?

Do you already have a passport? If not, read this.
For overseas travel you should check the policies of the nation to which you are traveling. Some are more rigid about what documentation you would need coming into the nation than others.
If you want information about custody issues for your state, you need to follow the instruction to identify the state with jurisdiction over the custody case.

I am travelling to Argentina, for my baby to meet his brother there. And my husband objects to I travelling.

What did you learn when you contacted Argentina's immigration service to ask what documents they require when one parent travels into their nation with a minor child?

I will get the passport next week. Argentina only requires for both parents to sign an agreement or some sort of authorization upon entering and leaving the country. And also the birth certificate. But since he refuses to sign the authorization...

You have Dad's permission for the passport yes?
