How to Determine Your Exact EB-2 Priority Date
Hi,
I am citizen of India and am currently on H-1B visa and my 6th year of H-1B visa with recapture period is expiring on January 5,2016.I live in Dallas,TX. My employer has filed my EB-2 Greencard application and my priority date is April 29,2015. As of 11/2/2015, DOL is currently processing PERM with priority dates of April 2015. My queries related to this are as below:
1) Is there a way to know EXACTLY which priority date is DOL processing? Can we know if DOL is currently processing cases with
April 1-15 OR April 25-April 30 timeframe? I am asking since my 6th year of H-1B is expiring on January 5,2016 and hence wanted to get an idea of timeframe of my I-140 AND H-1B extension under premium processing.
2) My current driver license expires on 12/13/2015. My employer has already filed for my H-1B extension but they did in October 2,2015 under regular processing. Is there a possibility that Texas DPS/DMV will give me a new driver valid until January 5,2016 if I show them just the I-797C receipt notice of my H1-B extension filing? What are my options?
Any responses will be greatly appreciated! Thanks ahead of time!!!
Re: How to Determine Your Exact EB-2 Priority Date
You can check the visa bulletin. There is no public record that is going to offer you greater specificity than the visa bulletin.
Documents deemed acceptable by the Texas DPS for driver's license purposes are listed here. The key appears to be that you are able to show that you continue to be lawfully present in the U.S.
Re: How to Determine Your Exact EB-2 Priority Date
Hello Mr. Knowitall
Thanks for your response.I just got to know from my employer that my PERM has been approved!!! Considering my I-140 and H-1B extension gets filed and approved by December 20,2015, when can I apply for my wife's H-4 EAD?She is traveling to India on December 7,2015. I can delay her travel to India by 1 month if we can get her H4 EAD approced by January 10,2016 based on my approved I-140. Is it possible to get H-4 EAD approval within 1 month of receiving H-1B and hence the H-4 extension?
