My question involves a child custody case from the State of: Alabama
In some circumstances, yes.
Parents have tested positive for drugs. Both financially unstable.
Is the state involved yet? If not, your chances are slim to none.
Parents are divorcing and the court ordered drug testing.
You will not get custody unless both parents actually allow you to have custody, or the State removes the children and you manage to convince them that you're the best placement.
Otherwise, not happening.
The child already lives in my home and has spent over 50% of their life in my care. Should I get CPS involved?
Tested positive for amphetamines, opiates, and marijuana. CPS had not been called. Child is under the age of 2. One parent does live in household but rarely stays in the home. By 50% I mean I have kept the child in my home3 to 4days a week since birth.
