Trespassing at an Apartment Building
My question involves criminal law for the state of: NY (NYC particularly)
So, I was with some people and we go to an open balcony area of an apartment building. We all had possession of marijuana. I was under the assumption that one of the people lived in the apartment building. I even called one of them while being detained who I thought lived in the building (but actually didn't). We were arrested with trespassing second degree (140.15).
This is my first offense, with a good education/work background. I am not understanding if I should plead guilty, not guilty or no contest to this.
Re: Trespassing at an Apartment Building
If you want to plead guilty (and "no contest" is treated as a guilty plea) you will be convicted of the offense charged. The consequences of your conviction will depend on the exact offense, but you should anticipate that even a violation is going to show up on future background checks. You should consult a local lawyer about what plea deals the prosecutor might be inclined to offer, based on the facts of the offense and your lack of a prior criminal record.

Plead not guilty and see if an acd is offered.

Currently this is a misdemeanor, sometimes they offer to reduce it to trespassing, which is a volition not a crime.
