Late Issuance of a Final Paycheck
My question involves labor and employment law for the state of: Virginia
Hi there. My question involves final pay. I left my previous employer in September and have yet to receive my final paycheck. They are aware they owe me my final paycheck as an employee sent me a text about it two weeks ago. Is there any recourse?

They didn't send you the text message for no reason. Perhaps they don't have your current mailing address. Perhaps the paycheck has been sitting at the office waiting for you to pick it up, and they wanted to remind you to come and get it.
What did they say, two weeks ago, when you followed up with them after receiving the text message?

They have my address. My address is correct in their system. And yes, they asked in the text if I wanted it sent to that address and I replied in the affirmative.
Does anyone know a link to where I could follow a sample DOL claim from beginning to end?

No. Apparently not - I haven't received it.
After I left, they initiated contact with me requesting return of a file cabinet key I had on my key ring. They advised check would be cut when I sent the key. I did and key was received October 6th. No check. So I contacted them and said am I to assume that there is no intent on sending my last check? That was roughly October 16th. Then they contacted me via text saying they had my check and asked about my address. I confirmed correct address and still have not received my check.
Unfortunately, this person does not believe the rules apply to him. I just wanted my money. I mean I have bills to pay too.

Haha yes I did that. But thanks for pointing me in the right direction. I was interested in the calculation portion. Which I did look up, like I looked up the FLSA implications, but have been unable to find any. With that being said, I asked where I could find a reference claim for example, not how to file one. But I'm glad you got to use your technical wizardry for your little joke. Kudos!

Not all states provide calculation info, since it's not your job to figure them.
