What to Do After Being Charged With Sexual Assault

i have been accused of sexual assault and assault against my brothers wife.
i was told by the phone lawyer not to say anything and leave.

I was wondering if i should say my side of the story as we did have sex but consensual. she got caught by brother and told him that then police

No one is going to help you construct your "side of the story." It sounds like you are guilty. You made your bed, now lie in it.

The lawyer gave you good advice,find a good lawyer and don't say anything without them present.

Not knowing any of the facts,this guy can be guilty or just as well telling the truth.

"Help me construct my side of the story" says it all. And "telling the truth" about what? He didn't claim to be innocent. He said he wants help concocting a story to make him appear to be innocent.

Wife sleeps with husband bother and gets caught,she has a lot to lose. She loses face,appears to be a UN loyal wife,etc. It's not out of the realm of reason that it's easier to lie and say rape then not have worry about the other consequences. This guy could of raped this lady,who knows. The duke lacrosse team,shouldn't tell their side b.c they must lying.

I'm not sure what a "phone lawyer" is, but if you were on the phone with a lawyer even before you left the alleged victim's home after the incident, that would be quite unusual.

If you have been charged with a crime, you should be working with an actual criminal defense lawyer. For sexual assault, you would want one experienced with sexual assault cases. Your "phone lawyer" told you to keep your mouth shut -- you should do that unless and until your real live lawyer tells you otherwise.

Even if we were inclined to help you, we can't. It will need an actual attorney (and as Mr. K alludes one with experience with sexual assault case). A defense is not just "spinning" your side of the story. Unlike the stuff you see on TV, it's not "your side of it." The lawyer will take an independent and critical look at the evidence against you and determine what evidence supports your case. There's no way you can relate the information over the phone or the internet in any way that is going to be effective.

Every lawyer I am familiar will tell a caller to SHUT UP and get a lawyer and in fact, will specifically tell them they don't even want to hear about the case until they have established the attorney-client relationship with you.

The state is required to prove its case. You should exercise your right to remain silent as your lawyer told you to. Giving a verbal statement of any kind can be misinterpreted and that testimony then used in court against you. By saying nothing, there is nothing for an officer or anyone else to confuse testimony about.
