    Used Car Buyer Wants Some Money Back
    My question involves a consumer law issue in the State of: Georgia/Alabama/West Virginia

    I sold my car about 2 weeks ago to someone from WV. I live in GA and the car was titled in AL. It has/had a clean carfax with no accidents. This was disclosed and verified by the buyer.

    The car was not perfect and flaws were pointed out and noted by the buyer. He purchased the car anyway. Now that it is about 2 weeks later he says that the srs light has been on for a week and took the car in to get looked at. They told him it has been wrecked. The buyer is now saying I illegally sold him this car with srs problems and he is going to take legal action which would require me to travel to WV to deal with them.

    The car was sold as is which was stated in the bill of sale. Does he have a case or does this fall under buyer beware? I didn't knowingly sell a car with issues. It was also in the family for roughly 7 years without any issues.

    He has no case.

    Tell him one time he bought it he owns it.

    Then hang up and never talk to him again.

    It's the talking that makes the trouble. The more talking the more they wear you down or get you to say something against your interests until you foolishly agree to pay them something to get rid of them.

    Thanks, I was thinking he didn't have a case but needed some more assurance. I'm thinking I'll just ignore his email threats of litigation at this point.

    This is a seven-year-old car that has been in your family since it was new, and you know for a fact that it was never in an accident?

    If you live in Georgia, and the car is titled in Alabama, it would appear that you never held title -- if that's the case, how did you sell the car and convey title?

    It's an 04 that was purchased from the original owner in 08. He has held the title ever since but it has been "my" car since 2012. He signed the title for a legal sale.

    The previous owner stated it wasn't in an accident and my brother nor I wrecked it. It also has a clean carfax.

    You sold a car that was titled to someone else without ever transferring title to yourself in the 4 years that you possessed the car?

    Now, THAT's illegal.

    I'm curious as to how that's illegal. It was my brother's car titled to him in AL and kept up with registration. I borrowed it for a few years and was on the insurance as well. Then we sold the car but I took care of the transaction.

    It's illegal because you didn't own the car and you broke your state's laws requiring you to register the car and for the proper transfer of the vehicle to a buyer.

    Did the insurance company know that the car was located in another state?

    If not, that's also insurance fraud.

    If you had an accident the insurance company would have been within its rights to rescind the policy and deny you coverage.

    OK, good.

    The open title thing might be trouble.

    But you can just turn a deaf ear to the buyer and see how it goes.
