    Can You Transfer an Expired H1B Visa
    Hi, I got my h1b approved in 2009 and for some personal reason I am not able to switch over from L1b to h1b during that time and came back to India.
    Now I wanted to know whether I can make use of this H1b, do I can request another employer to switch over it. Pls clarify me. Many thanks !!

    There's no such thing as transferring an H1B visa. A new employer has to start over with the approval though certain things don't have to be repeated from current visas (notably some of the cap eligibility rules). An expired visa is dead.

    I mean can I request my employer to apply for visa without going through lottery (I.e can I be exempt the cap)
