    Getting Child Support from a Low-Income Father
    My question involves child support in the State of: Nevada

    So right now i have a one year old and almost newborn and I'm living with my parents. The father was paying me 80$ a week for my daughter only. He got caught with a third time dui and is on a scram and house arrest bracelet. He's told me plenty times he don't want to be here for his children then changed his mind. I don't want to keep playing his games but need financial support. Most of the time he works and gets cash. He also has to pay his ex child support and his 2 employees and the two bracelets. He also lives with his parents. My question is if he isn't making much (that I can prove) and has to pay all these things will I still receive child support? Will it be a low amount? Another question I have is my parents are on a subsidize housing program and I'm not suppose to be living here or they Wil get kicked off the program. So if I didn't have an address to use (or if I did but didn't live there) could he use that to his advantage to get custody? (Even though he doesn't want it) or will the judge not grant me anything cause of this problem? Any advice will be appreciated I'm freaking out I don't know what to do. He also has a bad record of duis no license, long ago went to prison for his other kids. Got his other kids taken away cause they weren't being watched properly etc.

    No it was an agreement between us. I filed for child support this year and ended up closing my case because we were back together. While it's jot fully closed I was told we might have to go to court to reopen it.

    If the case is closed, you have to actually take action to get things going. As it stands, he owes you nothing and frankly you should have been extremely grateful he was giving you anything seeing as he had no legal obligation to do so.

    As far as the other matter goes ... well, let me put this plainly. Your parents can be in a whole heap of trouble if they're scamming the State (which is precisely what's happening).

    You're in a stressful situation, at least financially - it might be best for him to have custody if you can't support your child.

    He's under no obligation to pay you anything if there is no court order for support, but none of us will have the ability to tell you what he would be ordered to pay since we aren't privy to the financial records. If he's already under an order to pay support to his ex, then yes, your support order will be lower since they will account for those children first. As to his prior issues with the law, they won't matter. You already decided he was good parenting material when you had his children.

    As for your parents? They're committing fraud, so yes, once the authorities find out that you and your children are living there, there will be consequences which will including losing their housing, potential financial penalties and a possible lifetime ban on other housing benefits.

    What will you do if your parents lose their housing ? Its a shame you don't seem to care enough about your parents to not have them jeopardize having a place to live just so you and your children temporarily do.

    Having someone visit for a week is once thing but you CANNOT have someone else living there and not report it and not risk being terminated from housing. Your parents were the ones that signed the agreement. It doesn't matter to housing that you and your children have no place to live.

    Absent court ordered child support you have zero leverage....get a CS order...

    Even with a CS order it's close to impossible to,squeeze out money he doesn't have or find cash payments that have no paper trail or willing witnesses.....

    I know I have to take action and file another report to do anything, and for the person who said my kids are better off with him NO! His last two kiss got taken away and he never got them back all because they were under his custody. A drunken father does not deserve custody. For what to drive drunk with his kids in the car? Whichbhe has told me he has done before.Yeah I don't think so. Thank you!!

    You've got two kids under a year old and you're living illegally with your parents in their subsidized housing. You've got to be falling into the public assistance net somewhere. Surely they're counting you and your two children on their food stamp case, which is tied in with their Section 8 housing situation, and it will cross match somewhere and it will get caught.
