17 with Questions about Emancipation In Texas.
I'm 17 years old. A-matter-of-fact I just turned 17 yesterday. Well, I live with my mother that has full-custody of me. She agreed to letting me move out with my cousin that lives in another town. The reason for leaving is because last year around August I told my mom I was pregnant. She kicked me out and I went to go live with my aunt. Well, she called the cops on me as a runaway. So they had to take me back. Then she agreed to letting me stay for 3 more weeks. Two weeks later she came down to my job and said that my grandfather was having surgery and he has a good chance of dying. So naturally concerned for my family I come. My mom and my aunt are sitting in the kitchen saying it was an "intervention". Which i have no idea why? So I'm up here... My mom and I do not get along what so ever. Not even just a little bit. I believe she is crazy and my aunt is her accomplice. I just can't do this anymore with her... at all. I really need to get out. When she pulled me out of school, I was attending a self-paced high school... meaning I worked on one credit at a time in order to finish school by the time the baby was born. Well, since I was pulled out of it. I had no grades for the first 6 weeks of school. I worked my butt in order to obtain those grades... but i wasn't exactly successful. NOW I'm behind in high school. I won't be able to graduate till December of 2008. I want to get a job in the medical field. So if I were to move down there with my cousin I would be able to finish school by December 07. I would also be able to attend CNA courses that would allow me to make decent money... but the whole time I'll be getting paid to take them too. After six-months I could go to work at the hospital. They would pay for my tuition for college. So I'm thinking over there is better then staying here. What do you think? Do you think I can do it? Right now I'm trying to find a job to pay for a lawyer & etc. Do I have to not live with my mom in order to obtain an emancipation? I need legal advice... so please help me...

Texas requirements for emancipation:

(a) A minor may petition to have the disabilities of minority removed for limited or general purposes if the minor is:
(1) a resident of this state;
(2) 17 years of age, or at least 16 years of age and living separate and apart from the minor's parents, managing conservator, or guardian; and
(3) self-supporting and managing the minor's own financial affairs.
(b) A minor may file suit under this chapter in the minor's own name. The minor need not be represented by next friend.
I'm confused, is your mother giving you permission to move or did she give you permission before, but now is not letting you go?

She gave me permission before and is no longer allowing me to go.

I see - that is why you are trying to get emancipated.
Emancipation is very difficult, you would need to prove to the court the above requirements.

I can support myself, I did support myself for a while with out my mother's help. I know its difficult because I was going to go through this process when i was pregnant. I ended up having a miscarriage and I dropped it. So what do I do... My mom is crazy and I can't do this anymore.

You must be able to prove you can and are supporting yourself.
If you are unable to get emancipated, you only have two choices:
1. Have your mother's permisssion
2. You wait until you reach the age of majority

Get a full-time job and support yourself 100%.

i dont know how to post so can i borrow this place real quick?
i plan on moving out in july after i turn 17, with my bf which is going to be 19 in may and i know my mom will call the cops on me so we are going to get married the day i move out without my parents permission at JP. I have my own job and so does he we have a place on his parents land and i was wandering if there is any way for me to get emancipated?

How do you plan on marrying without parental consent?
§ 2.003. APPLICATION FOR LICENSE BY MINOR. In addition to the other requirements provided by this chapter, a person under 18 years of age applying for a license must provide to the county clerk:
(1) documents establishing, as provided by Section 2.102, parental consent for the person to the marriage;
(2) documents establishing that a prior marriage of the person has been dissolved; or
(3) a court order granted under Section 2.103 authorizing the marriage of the person.
