Name Change of a Minor in Texas
My baby's father is in jail and goes to trial facing a possible 25 yr. + sentence. My question is how do i go about getting my 2 yr. old sons last name changed to my last name? I have custody papers but he is not willing to sign, but i think I have good reason since he commited a very bad crime and i don't want my son to grow up with the last name of a career criminal.

Petition for a name change in court, and prove to the court that the name change is in the child's best interest.

I'm new to this how do i start the process off? I don't have a lot of money. I go to court on Feb 5 to hopefully have the judge order him to sign the custody papers but so far he is unwilling. Where do I get a petition form?

You may be able to achieve a name change through your current litigation. Of course you initially chose not to tell us that you had a matter pending in court, and haven't described the nature of the hearing beyond it somehow relating to custody. You should consider consulting a lawyer.

the matter is just so i can get soul custody of my son since his father is in jail. he is now taking me to court to vacate a protective order. he has refused to sign the custody papers because of this protective order. i do have a lawyer but i don't have to money to keep paying him. so if i can do the paperwork myself it would help a lot since i don't get any help. thank you for your respones.

Talk to your lawyer about the possibility of amending your current petition to modify custody to also include a petition for name change.
