How Long Does a Doctor Have to Complete FMLA Certification
My question involves labor and employment law for the state of: Texas
My wife had to be admitted into the hospital and her work put her on a medical leave of absent. They sent us the paperwork we need to fill out and paperwork for the doctor to fill out under FLMA. I took the paperwork the doctors office and ask the when I could pick up the paperwork. They told me they would contact me when they have completed the paperwork Her employer HR department told us that they needed the medical certification paperwork back to them within 15 days. It has almost been the 15 days and I still have not been able to get the completed medical certification from the doctors office. Is there a time limit on how long the doctor can take to complete the medical certification?
Re: How Long Does a Doctor Have to Complete FMLA Certification
To be absolutely honest, there is no requirement that the doctor complete the medical certification at all.
Yes, I realize that there is a requirement that your wife provide the completed documentation before she can be approved for FMLA, and that if she does not she does not have to be approved and can potentially lose her job. (We'll talk about that in a minute.) This is what I, at least, see as a hole in the process. The law puts the onus on the patient without putting a similar one on the doctor. I wish it were different, but it was not.
I have a specific reason for asking this question, and it relates to how to handle this if the doctor misses the deadline. How long is/was she in the hospital?
