    Violating a Store's Trespass Ban
    My question involves criminal law for the state of: Ohio

    I got banned from Walmart over a year ago. Went to the parking lot today with friends, no intentions on going in. Happened to see other friends there. Ended up getting the cops called because people were messing around too much. The police got our names, Walmart manager came out and got our names too and all signed papers saying we are banned. BUT I'm already banned for life, but they didn't seem to recognize me or my name. (Also a different manager and security from last year.) My question is.. Will they find out I'm already banned and on the property? I signed a paper last year too by the way. Are they going to find out? I'm really nervous right now.I feel like they would've done something then if they knew, but I'm don't know if they still have the information from last year.

    It's quite possible that when they enter the new ban info, they'll note you were already told to stay away. It's unpredictable if they will file a complaint with the police over your criminal trespass.

    4th degree misdemeanor ?

    I'm in Ohio.

    4th degree misdemeanor under state law, I believe as stated above, but most cities and municipalities have their own ordinances that mirror state laws but often make most everything a first degree misdemeanor - so it's a safe bet that you could be looking at a maximum fine of $1,000 and 6 months in jail. You wouldn't likely actually receive that, obviously.

    None of us can predict the future, but it's unlikely, based upon what you've written, that they will pursue this matter further after the fact. But stay off their property from now on. It's really quite simple. Then you won't have anything to worry about.

    Yeah, I didn't even know we were going there nor did the driver know I was banned. He said we would be quick when they all went in but drove off and saw friends at the end of the parking lot. I literally stayed in the car because I was scared but when the cops arrived, I was asked to get out of the car.
