Driver Charged With Contributing to Delinquency of a Minor Due to Drugs in the Car
My question involves criminal law for the state of: Oklahoma. Hello i was charged with Contributing to the delinquency of a minor. My question is can i have them drop the charges considering i did not contribute anything to the minor in question and that i did not have anything illegal or incriminating on me. I was sober and the minor in question also had nothing incriminating on him they found paraphernalia and marijuana in the vehicle but they did not charge me with possession or anything other then Contributing to the delinquency of a minor and my friend only had gotten charged with only a curfew ticket. .

We don't have enough facts to comment on the prosecutor's theory or the strength of its case. I suggest discussing your case in detail with a criminal defense lawyer.

You've got that 100% wrong.

Probably because "contributing" is a much greater offense. It's a felony that can get you 20 years in the pen.
Read the statute:
21-856.1. Causing, aiding, abetting or encouraging minor to participate in certain drug related crimes.
Every person who shall knowingly, intentionally or willfully cause, aid, abet or encourage a minor child to:
1. Distribute, dispense, possess or manufacture a controlled dangerous substance, as provided in the Uniform Controlled Dangerous Substances Act, Section 2 101 et seq. of Title 63 of the Oklahoma Statutes;
2. Create, distribute, or possess a counterfeit controlled dangerous substance, as defined by Section 2 101 of Title 63 of the Oklahoma Statutes;
3. Distribute any imitation controlled substance as defined by Section 2 101 of Title 63 of the Oklahoma Statutes;
4. Conspire or participate in any scheme, plan or act for the purposes of avoiding, eluding or evading arrest or detection by law enforcement authorities for crimes involving controlled substances as defined by Section 2 101 of Title 63 of the Oklahoma Statutes; or
5. Violate any penal provisions of the Uniform Controlled Dangerous Substances Act,
shall be guilty of a felony punishable by imprisonment in the State Penitentiary for a term not more than twenty (20) years and a fine of not more than Two Hundred Thousand Dollars ($200,000.00). Said sentence shall not be subject to statutory provisions for suspended sentences, or deferred sentences except when the conviction is for a first offense.
Now get yourself a very, very good criminal defense attorney.

I suspect that the actual statute under discussion is,
Quote:
Quoting Oklahoma Statutes, Sec. 21-856.
A.
1. Except as otherwise specifically provided by law, every person who shall knowingly or willfully cause, aid, abet or encourage a minor to be, to remain, or to become a delinquent child or a runaway child, upon conviction, shall, for the first offense, be guilty of a misdemeanor punishable by imprisonment in a county jail not to exceed one (1) year, or by a fine not to exceed One Thousand Dollars ($1,000.00), or by both such fine and imprisonment.

I was going to say - I don't know specifics of OK law, but I'd be surprised if this was being charged as a felony given the circumstances.

You mean your first time being caught. It likely wasn't the first time you had that stuff so don't pretend that you're some kind of angel that society is picking on.
What, exactly, are you being charged with?
You see two statutes posted above. The statute number will appear on your citation or charging papers.
Either way, you still need a lawyer. Your an adult now and can be sent to prison.
