If a Victim Changes Her Story Can She Be Charged With Filing a False Police Report
My question involves criminal law for the state of: Michigan
I am the "victim" in a domestic violence case. I may have grossly over-exaggerated what happened to the police, in order to get the fella out of my home. I went the next day to try and drop the charges but the state picked it up and are currently holding him on 2 felony convictions. I mailed a notarized/signed affidavit to the prosecutor explaining what really happened in hopes of not getting a perjury charge once I took the stand. I have yet to receive a response. I consulted with a lawyer who informed me that I should “invoke my fifth amendment rights” but I do not know how that will work after sending the affidavit? The lawyer also said that if I testify I could get charged with: Falsifying a police report, perjury and obstruction of justice. How bad did I mess this whole thing up? I have absolutely no criminal record, never had to be in a courtroom besides my divorce, I have never even called the police before in my life. Being who I am and believing in the truth, I cannot go in there and lie. Is there any way that I can possibly get out of this mess without ending up with some criminal charges of my own? Any advice will be greatly appreciated.
