If I can show a document that was falsified would that change my standings? When I received the first letter of op the amount was $1745.00. i went to the dhhs office and talked to a case worker to find out why. She dialed a number and handed me the phone. I explained to this person my situation and he brought up my file and looked it over and said the amount was incorrect and reduced to $588.00. i told the cw I wished to appeal it and the paperwork was filed. When I had my hearing {by phone) the person who filed the op against me saw that the amount in now being disputed was 588.00. He had no clue what happened to the 1745.00. He told the judge that he could not locate the original letter. That's because it was no longer the amount in dispute. So the hearing was for 588. A few days later I got a letter of op for the 1745 again. He went in his files and re printed the letter and added the 588 and the 1745 so that now I owed the 2 combined. A case worker said that the original amount that was re sent should have said "reprint" on it but it didn't. The time frame for the first letter($1745) was 08/2014-01/2015. Three of the same months with the same amounts were used in the second letter. The second go round the judge ruled in my favor because the facts and amounts did not add up. I think his cage was rattled! When he appealed that ruling, he brought back up. A supervisor who had gone and did her handy work revised this and that tidied up the mess the guy had created and on top of that increased the total to $2330.00 that I now owe. For a program designed to help people in need and now creating the worst time in my life, I don't get it. Why is this allowed to happen? We stopped receiving food stamps in Feb. Is Mr. Ricketts okay with these procedures? This shtuff needs to be revamped. Some new mo's need to be put into motion.

But there was fraud or misreporting on your part, right? BEFORE all this other stuff happened, there was food stamp fraud, done by you. That hasn't changed.

And you know this because.......you seem to have a preconceived notion that mistakes made, that result in over payment of food stamps, couldn't possibly be due to DHHS error. Why are you so quick to place blame on me? Also I get the feeling you're not a legal professional offering advise but a person with a prejudice towards people who receive food stamps.

You never said there wasn't an overpayment. You never said you didn't commit fraud just that the amount was wrong. So its plain this didn't happen because you did nothing wrong.

Excuse me? What makes you think that I was being fraudulent? It is stated in my paper work that the all the errors made that caused the op's (that stands for over payment) were due to AE! Do you know what AE stands for? ADMINISTRATIVE ERROR. it is stated that I have the right for a fair hearing. Fair for them. And, politeness has nothing to do with it. Why don't you try being polite and not so judgmental? Your tone here seems to be that of a person who has a bad attitude toward people who receive public assistance. Yes, there are people who abuse the system, live off the government and don't try to better themselves. However I am not one of them. I did not falsify anything for my gain. Go dump on someone else. I am 60 years old. At this point in my life I just want to live comfortably and be content, but that is not happening for me. Picking up what I,m putting down? I seriously doubt it.

If you are describing proceedings within DHHS, in front of an administrative law judge, and you have now exhausted all of your administrative remedies then, as you were told, you can take the matter to a regular trial court and try to convince the judge in that court to rule in your favor. As surprising as this may be to you, I can't see that letter from where I'm sitting. You seem to be suggesting that the letter says that you have ten days to pursue.... something. If by that you mean that you have additional administrative appeals that you have not yet exhausted, then you can pursue those appeals.
