Meeting with Loss Prevention Over Fraudulent Returns
My question involves criminal law for the state of: Florida
I am a retail manager and was doing fraudulent returns to cover up cash shortages instead of reporting them. I have been given information that loss prevention is coming tomorrow to terminate me for violating policy and attempt to charge me with theft. I didn't take any money but did contribute to company loss through my actions. options are go to meeting admit what I did and defend against theft. Worried they will arrest me there on the spot. Other option is do not show up for work, resign and obtain an attoney in case they pursue charges.

They're going to fire you for your fraud as it is. I would not talk to them without an attorney who will probably advise you not to talk to them at all. What they're going to do is try to get you to admit you owe them restitution for the shortages.

That was my thinking too. If OP had just reported the shortages, LP would have come in and investigated that instead of OP.

Option #1 - sit there, don't admit and make them prove that you committed the offense (video etc)
Option #2 - resign and make them come after you.
Option #3 - admit what you did and move forward with a clean mind.
How did you find out LP is coming for you?
What kind of retail store are you in? National? Regional?
Do you have a relationship with your Lp partner?
Did you take any of the money?

You can be fired based on the suspicion.
You cannot be convicted of a crime without evidence proving, beyond reasonable doubt, that you did it.
I suggest you consult an attorney but if it's too late this afternoon to do that just go in and let them do what they gotta do and just say no comment to any questions and keep saying it over and over again until they either kick you out or have you arrested.
