Emancipation from One Parent but Not the Other
My question involves name change laws in the State of:Missouri. My fiancee daughter lives with us and my two boys. She wants to be emancipated from her father and take my last name when her mother and I get married. Can. Her dad doesnt help with anything or even talk to either mom or daughter. The other question is can she have herself amancipated from just her dad?

Emancipation does not mean "divorcing your parent(s)". It is an acknowledgement by the state that you are a legal and self-supporting adult. If she is not living outside the home and paying 100% of her own expenses she does not qualify to be emancipated at all, and emancipation is something that either you are or you aren't. Emancipation from one parent is a dog that won't hunt - it simply cannot happen.
