Green Card Application for Family Members
Hi. Me and my family live in the US (me on H1B, wife and son on H4 statuses).
My employer is working on "I-140 Petition for Alien Worker" + green card application for me (forms G-28, I-485, I-131, I-765, and G-325A), but doesn't cover expenses for the family members.
My question is: where can I find a full list of documents required for green card application for my family members?
I would like to submit all documents all together.
Thanks!
Re: Green Card Application for Family Members
There's a lot of information on the USCIS website. Start here and work through other pages relevant to your situation.
Re: Green Card Application for Family Members
Hi, the page you shared is about "Family of Green Card Holders". I'm not a Green Card Holder, I just want to become one, but process everything together with my family members.
I don't think I can submit I-130 not being a green card holder... Does that mean I should first get a green card and only after that start processing family forms\docs?
Re: Green Card Application for Family Members
If you want to sponsor your family as a H1B visa holder, and aren't asking about what you would do if and when you become a permanent resident, then you're talking about getting them H4 visas. Is that all you are trying to do?
Re: Green Card Application for Family Members
No, as I mentioned in the initial message, they are already H4 visa holders (I'm a H1B visa holder) and we all live in the US.
All I want to do is to process green card applications together. All forms related to me (G-28, I-485, I-131, I-765, and G-325A) are being processed by lawyers, I need to prepare all family-related forms by myself. That's my question - where can I find a list of such forms and procedure description?
The link you gave me describes the procedure as if I were already a green-card holder.

As mentioned at http://www.alllaw.com/articles/nolo/us-immigration/filing-i-140-i-485-concurrently-speed-up-green-card-process.html,
"If you have dependents (spouse and children) who are filing for their green cards too, each dependent must complete an entire I-485 application as well, including photographs, medical examinations, birth certificates, and so on."
Question is - is this the only form (I-485) needed to be filled by them? Should I-130 or any other forms be filled as well?
Re: Green Card Application for Family Members
For family members on derivative visas who do not intend to travel outside of the United States, it generally makes sense to file an I-485 sooner as opposed to later to avoid the risk of their falling out of status. If they intend to travel internationally, it is a good idea to discuss timing and other options with an immigration lawyer.
The petitioner for an I-130 must be a citizen or lawful permanent resident of the United States. Refer to pages 4-5 of the I-140 form filed by your employer, which addresses your dependents and whether they will be seeking AOS.
Re: Green Card Application for Family Members
Thanks, so if I understood properly - I just need to put family members details into form I-140 and file I-485 for each of my family members (no G-325A etc required for them), right?
Re: Green Card Application for Family Members
Your employer will be submitting the I-140. Yes, your employer should include your family members on the form and indicate that they will be seeking AOS, consistent with the form and instructions (and, of course, their intentions). Family members over the age of 14 can file their G-325A with their I-485.
Re: Green Card Application for Family Members
Thanks, so the full list of forms for my wife looks like below:
- 6 Photos (2x2)
- Medical Examination
- Evidence of Birth (copy)
- Evidence of Birth (translation)
- Passport (full copy)
- Signed forms:
I-485
G-325A
- Marriage Cert (copy)
- Marriage Cert (translation)
- Fee ($1070)
Any mandatory forms\papers I forgot to include?

I'll reply for myself - just google for "adjustment of status application checklist" and you will get a lot of checklist examples (especially from US Universities) - they describe the full list of docs for a concurrent I-140 submission case, so my list above is not full yet. Thanks to everyone replied in this thread!
