Can You be Put in Jail for Nonpayment of Child Support
My question involves child support in the State of: California
Actual Chances of dead beat dads going to jail that cant afford to pay? (based on statistics or real world estimation)
For example: 20% 50% 75%
So lets say you have 100 fathers who live off 800$ a month, and "they cant afford to pay" is their excuse. If they went to court, what are the chances the they'd be thrown in jail for contempt?
And for how long is the avg stay in county jail or prison?

It really depends on the judge. It can also depend on how many times the father has been in court for not paying. But, if they are working and paying taxes, the IRS will send the tax refund to the parent it is ordered to go to. So if the father is jailed and loses the job, there will be less money from the tax refund the next year.

so would u say 25% of non payers that are unemployed( or living off disability) will be thrown in jail? Wouldnt a judge be more lenient if they knew the noncustodial was jobless and or living off ssi?

If they were living off of SSI because the SSA determined that they were disabled, yes, in virtually every jurisdiction a judge would not put them in jail.
If they were unemployed? That is a whole 'nuther story.
