    Can You Get a Temporary Order Reducing Child Support, Pending a Hearing
    My question involves child support in the State of California:

    I have been unemployed for almost three years. I have nowhere to live and no money. I finally got a job and have received an order from my employer stating that more than half of my net income will be taken to pay child support. Mind you I have only been working for three weeks. I am days away from living on the street and I have filed to have a hearing. The problem is that the hearing is not for two months and by that time I will have completely ran out of money. I am currently living in a motel that I can't afford even though it is the cheapest one I could get and I don't even eat every day.

    Because of my living situation I will probably lose the job that took me almost three years to get and I will be completely homeless. My question is; is there something I can do to immediately lower or stop payments until the court date so that I can at least live?

    If you can, please help me as I am desperate. I don't know what to do or who to turn to.

    You've already filed for a hearing and until then you're expected to pay as currently ordered. But I do have a question. Why have you left it until now?

    Realistically, if you don't pay between now and the hearing the amount you owe will just add up and keep adding up.

    Your kids deserve the support though. You are thinking of them too, right?

    I have not left it. I have not had a stable place to live for years so I have never been served or anything. The payment has always been taken out of paycheck. I don't know what happened but the payment has more than doubled since the last time I worked. The kids in question are both 18 now. Even though the kids deserve support do I deserve to go to work everyday and have to live on the street?

    Have you considered applying for assistance for a short while? You may qualify for food stamps or other help..better than not eating at all.

    If you have to live on the street, it's largely because you didn't support your children. Nobody else is at fault.

    Did you actually have a legal question?

    You have no idea what you are talking about. The payments have always came out of my paycheck. And who said it was somebody's fault. I was asking for a little help. I asked if there was a way to lower or stop the payments until the court date so I can get a place to stay. But since dogmatique is a a-hole my reply to you is to go suck your mother's dick! **** this site.

    If the children are 18, unless they are still in high school what you're paying is arrears. You also may.not see a tax refund until all back support is paid. Even if the court stops payments going forward, you will still owe the arrears.

    If his children are over 18, he is obviously older. In this economy, older workers are having a really tough time getting any kind of a job. Even vets with graduate degrees are losing jobs and are deeemed unemployable while we import young workers to fill even entry level jobs.

    He hasn't always been older. The mother is entitled to be paid for the support he didn't pay earlier because she is the one that supported the children with no help from their father.
