    State Tax Refund Offset Was Recalled by the IRS
    My question involves child support in the State of: I recently called the Florida department of revenue and discovered that a refund offset for apprx. $3400.00 was recalled back to the IRS. I can't get any answers as to why or how long it will take to process and be sent back to the DOR. My ex is not married so there is no injuried spouse and when I call the IRS OR DOR they tell me they can't give me any information. My ex got the "leftover" of her refund back in February. It's been over 6 months... Looking for some advice or direction. Any help would be appreciated.

    Unfortunately, under federal law the IRS cannot disclose to you anything about your ex’s tax return or related information, including whatever issues the IRS may have with her returns. Nor may the state DOR disclose that information as it is bound by an agreement with the IRS not to disclose that federal tax information. There could be any number of reasons for why the refund offset would be canceled. For example, the IRS may have determined she owes additional federal tax, either on that return or on other returns, thus reducing the refund that would be offset to pay child support. She might have filed bankruptcy, would would prevent the offset unless relief from the automatic stay has been obtained from the court. Or it could be something else. All you’ll really be told is whether or not you’ll get anything.
