Towed from Registered Parking Spot While Waiting for Replacement Parking Sticker
My question involves landlord-tenant law in the State of: California

Recently, we got a new owner which means new rules and regulations. They've been extremely disorganized from the start in failing to repair requests within a timely manner and the list goes on. There has been new parking rules that now we must have stickers on our vehicles whhile parked in our registered parking spaces. Which is not an issue. However, my husband lost our sticker and requested one 2 weeks ago. They said they currently did not have any on hand and would get back to us... theyt never got back to us. Last night we parked in our registered spot around 11:30pm for the evening and walked out to the car at 7:30am to see our car had been towed due to not having a sticker present. We paid the same day to take out our vehicle $230.Their offices have already been sloppy in business and did not warn my husband not to park in our registered parking spot while waiting for a new sticker. After speaking to our property owner about the issue he has not budged and thinks he is not at fault. We believe this is their issue. If they expect us to adhere to the new rules and regualtions they should be prompt with their services and follow up to ensure they've provided the materials necessary to ablidge.

    Please advise.

You knew the new rule that required a sticker.

You had a sticker and lost it.

    You parked without a sticker.

    You got towed.

I don't see where the owner did anything wrong.

The owner has no obligation to replace your lost sticker on your timetable.

Frankly, it should have been affixed to your vehicle the moment it was in hand. Without it your car could have been towed one minute after the sticker was provided if it wasn't on the car so what's the difference as to when you were towed?

If you don't agree you are welcome to sue the owner in small claims court and see if you can convince a judge that you are correct.

i would possibly agree with you if this office was organized and on top of prior requests made. For example: i called in for my oven (that is their property) to be fixed 6 months ago it took them 2 months to follow up and come through on my request. It broke again, i called it in right away and they've YET to come replace the part. In my opinion; they've step back on their rental agreement with us in so many ways already that to not give any grace when it came to this is beyond hipocritical and unfair.

"Hypocritical" and "unfair" are not legal doctrines.

However you might have recourse for a requested repair that is not done in a timely manner.

Educate yourself with this CA landlord tenant guide and see if there is anything in there about "repair and deduct."

    http://www.dca.ca.gov/publications/l...k/catenant.pdf

Where statute numbers are given make sure you look up the statutes. If you ever had to go to court over it you'd have to quote the exact statute and not the guide.

    http://www.leginfo.ca.gov/cgi-bin/ca...ebody=&hits=20

If there is a "repair and deduct" process that you want to take advantage of, follow the prodedures to the letter.
