Offender Blackmailed Over A Probation Violation
A close member of my family was convicted of rape third in new york about a year ago. In the time since then he has committed a probation violation which is unknown to anyone but the victim. Now the victim is blackmailing him in order to make him wait to be with her. He wants to move and is wondering if he moves to another state and does not contact her, can he get in trouble with his new probation officer in his new state, or will he have a clean slate? He wants to move and restart his family, he has a wife and kids, but this girl is preventing him from doing so. Advice beyond the realm of get a lawyer and turn self in...or is that really the only option?

Has he even discussed moving, and the transfer of his probation, with his probation officer?

Yes he has, and his officer seems open to the situation,however the officer does not know of the contact. He lost his job in new york and would also like to move for that reason, as he is having trouble finding work in this area. The sex offender laws are also tougher in new york than in other states, and he would like to find a state where he does not have to register for life. He just wants to know if he moves to another state and never violates probation again, what happens in new york?

If he has violated his probation in New York, he can be taken back before the New York court over the probation violation. The longer this person waits to report the violation, the less likely it is that action will be taken. But we don't know the context, so we can only guess. If he wants advice as to his probation violation, he should consult a criminal defense lawyer so he can discuss the full details of his conviction, sentence, and the violation in confidence.

Thank you, you have been most helpful. He is hoping that by moving, the girl will forget he exists. All he wants is a chance to restart his life with his family somewhere. She did threaten him via text message, and he saved all of those, so its not like she is totally blameless and he has no evidence of it. Thank you again for your help.
