Thats what I thought!! I didn't think the constitution allowed for that. Well that is about it. I am done with all my questions. You have all been a great deal of help. Along with telling me what you really think of people who do stupid things and know they are wrong. I still to this day can't believe I did it. Funny thing is 4 days after this started I was diagnosed with a borderline personality disorder!! WOW!!!

Does the disorder excuse your behavior?

But statements like one you gave suggest you do. It suggest you have not taken full responsibilty for your actions. I do hope that is incorrect otherwise we might see you here posting on what to do about your second or third offense!

OH - NO- my dad would KICK my ARS literally. He had to put up 2022.00 for my bail and I am in NO position to ever even THINK about that again. In fact when I walk into a store and cash out now- I DOUBLE check to see if EVERYTHING was counted for and paid for. I take NO chances now- OR will I in the future........EVER!! I wish I wouldn't have done it this time. We all make mistakes but you can't call them that if you don't learn from them. I HAVE LEARNED. NO-WAY will I be on here asking about my 2nd or 3rd. You will be lucky to see me on here FOR ANYTHING again!! I LIKE- NO - LOVE my freedom and the thought of a county inn for a vacation isn't sounding very pleasant. I just hope you all are right about my consequences because after talking to you- I am thinking about just pleading guilty wednesday if they give me a plea of fines, probation and comm. service. I mean I am NOT innocent so I mine as well SUCK IT UP. If I get like 10 days or 15 days jail then i'll take that too. It will be beneficial to me to know that you don't just get a slap on the wrist for idiocracy!! I appreciate EVERYTHING ounce of knowledge and wisdom everyone has shared with me today!!!

If your going to do that (thats fine) you or your Attorney need work out a plea deal first! Plea deals are not made in courtroom!!! Plea deals are made between DA and defendant or his Attorney. both parties agree to plea deal and that plead is offered to judge. He can accept or deny it. (they VERY rarely deny it) Jusge might then ask you if that is what you want you reply yes. Then judge accepts plea deal and you get that punishment! If you walk into courtroom with no plea deal and plead guilty you will be charges and punished per the law for that crime and that could be max!

Well that is good to know. I didn't know that you could actually tell the prosecuting attorney what you wish for your plea to be if you plead guilty. I have never had that opportunity before. I have had a couple DUI's but I plead guilty to both and they got dropped. I got a delayed jail sentence upon completion of my probation and I completed it and paid my fines and that was that. Never been in trouble for it again!!! Even went to AA/NA for 3 1/2 yrs and stayed completely sober. Then on July 16th 2004 I found my b/f dead in my bed at 35 yrs old from a heart attack!!! THAT sent me to relapse!!!

Its fairly simple you go to DA and ask him what he will give in exchange for a guilty plea? Tell him you want no jailtime the rest is pretty much up to him since he has you! DA, judge etc dont want to go to court even for a win if they can its time consuming and costly. Remember dont be demanding he has you! If you have an Attorney its best he/she work out plea deal!

Thanks again I will remember that and keep all this advice under my pillow so I don't forget it. I need to just claim my faults anyways and get it over with. I hope for NO jail time but regardless of my consequence I still need to just be done with it. PLAIN & SIMPLE!!! I will talk to my court appointed attorney about this. I guess there is NO need to hire or spend thousands of dollars on a defense attorney if they are just going to show more evidence against me in a trial. Another question- is video admissable in court or not? The reason I ask this is because YES- it is accurate but can ALSO be tampered with?

Sure challange the video create a scene and take courts time see how that works once found guilty! Kiss plea deal goodbye. You watch too much TV!
