Shoplifting Charges for Opening Merchandise in a Store
My question involves criminal law for the state of: Texas
Well I was in best buy looking for tempered glass for my phone because mine is shattered. I open the box to make sure it is the actual glass kind which it wasn't so I close it and put it back and as I am walking out I saw phone cases for sale. But I am picky and only like a certain kind. So I open the packages for 2 so I can compare the 2 they aren't taped closed or anything so I make my selection put everything back together and go to the front but as I am walking out this guy looked at me and then him and his partner walk into their video room and as I walk out he looks at me again from the door. My questions is if they didn't stop me at the door how long do they have to file charges? How would I know if they decide to take action? Should I go back to best buy and double check I got the right one? I don't know what to do! I am freaking out!

I did make a purchase. I only opened the packages to ensure I was purchasing the correct thing I wanted. I waited and walked around looking for help but had no luck. I thought I put the stuff in the right packages but if I didn't I don't want to get hit for it. I took the one I wanted and paid at the register. I paid cash.

There are always employees in blue shirts (lots of them) walking around in those stores.

I know they are normally really good about help. I found someone long enough to ask them where the tempered glass was but they were helping someone else so they couldn't stop to really help me.

Good grief, you claim to be oh-so-particular about what you buy, and now you're telling us you don't even know one item from the other, or which you purchased? You switched the items to buy a more expensive item in the box for the cheaper item. If that were not the case you would not be worried about whether the store will figure out that you switched the items.

My question is still the same. Should I go back to the store to correct the issue or am I screwed either way?
