Can a Landlord Add a Roommate to the Lease Without All Co-Tenants' Consent
My question involves landlord-tenant law in the State of: New york
My roommate and I both have girlfriends. They both stay with us (whole different issue, and yes violation of the lease). His girlfriend was just added to our lease (its up in October) and she isn't to fond of me and my girlfriend. She tells lies to make her sound better, actually turned the hot water off on my girlfriend during a shower so she could use it and is just all around a deceiving person. My landlord said he wouldn't renew for me because my girlfriend "lives" here, and she has a key which isn't allowed. Nothing on the lease about not giving a key to someone. The kicker is my roommates girlfriend has been here just as long. She actually was renting upstairs still while living down here and had a key before my girlfriend ever did. We think she wants to stay and is trying to get us kicked out. Anyway I was never informed of her being added to the lease. Is that allowed? My landlord told me its between me and my roommate to talk about but he claims he didn't know she was added either. Not sure if I trust him though. Please Help! Also..is that some form of discrimination?

huh?
if the landlord was not aware she was added then she was not added. It's not something that could be done without his willingness.
do you rent an apartment or rooms in a house?

lease renewal in NY is a bit quirky and even more so if you are in NYC and under rent stabilization ...in a sense it's to LLs advantage to change things so as to get rent increases in place and rents in NYC are one rise..If you are in NYC.
I strongly suggest you dig into whatever the rules are as to your specific jurisdiction.
As I understand it in NYC the tenant has what amount to renewal rights .
It's not your LLs job to sort out games of who turns the hot water off! If you and your GF cannot co exist with the others, then it's perhaps time to move on?

The landlord was aware. ....hes the one that added her. Im asking can he add someone without both me and my roomates consent...or does the LL just need my roomates consent? I was umaware she was added to lease. Im in upstate ny not the city. I know its not LL job to sort out games....just wanted to give a little backstory is all.

Also she has done the same thing my girlfriend has (regarding having a key and living here) and they havent gotten talked to. I feel like im being discriminated against

It's probably a violation of lease to unilaterally add more parties to it without consent of all.
Even of if its a violation Im not sure just what logical cure one might expect or how you were damaged. I would hope you have a copy of lease as you signed it ?
Drama over a key isn't any form of illegal discrimination.

Which is it? Why is it that you're "not sure" if you can trust the landlord, but are also stating that the landlord is lying?
Note, there would be a huge difference between recognizing her as an occupant of the premises and actually making her a co-tenant. If she's an occupant, then the tenants may have additional duties under the lease or may owe additional rent, but the "consent" to her being recognized as an occupant came when you allowed her to move it.

I wouldnt say i was damaged....just dont want her there. She causes issues. Not drama over a key..but the
Fact that the LL is singling me out for the same stuff my roomate has done. I do have!the lease copy that me and him signed...just our signatures not anyone elses

I was reffering to my roomate about the trust issue. He claimes he didnt know about her being added. So if thats true then neither of us knew

Also our lease states that our apt (#1) is known as premises. Says any pet must have a deposit to be on said premises. Shes had her dog in our place for months but the landlord said its ok because she paid the deposit for upstairs (apt #2) and the dogs covered for the whole building. Isnt that the LL breaking his own lease. Like the dog's deposit paid for apt 2 premises and our apt is a whole different premises . Sorry for all the questions just feel im getting bullied out of renewing lease and am frustrated

If nobody knew that the girlfriend was added to the lease -- not the landlord and not the tenants -- then it didn't happen.
If the landlord doesn't object to the dog, then he's not enforcing any provision of the lease that would otherwise prevent the presence of the dog.
Your lease is almost over. I suggest that you create a plan for relocating at the end of your lease term.

The landlord knew....hes the one that said he added her. So landlord knows but what if both tenants didn't...or if only 1 knew? What exactly does it mean if hes not enforcing any provisions of the lease? Basically if he says its allowed then it is?...even though the lease states differently? Yes we do have a plan but that doesn't mean I wont still fight.

But she moved in while still being on lease upstairs...not my place. I don't think the LL knows this

I think the landlord is regarding her as an occupant, not a tenant. If she is claiming to be a tenant, ask her for a copy of her signed lease agreement and we'll work from there.
