Do You Still Get Vacation Pay or PTO After You Quit
My question involves labor and employment law for the state of:NY
I quit my job after a year and 6 months due to mental and verbal use by the owner. He would constantly call us lazy in meetings and at the last meeting said we were "duuuh retards" so I quit after the meeting after I told him I didn't appreciate that after I confronted him about it the week before.
I was on vacation the week before with my gf who works there as well. Mon and tues we were in Florida and returned to work for 3,8 hours shifts on weds, thurs and fri. I got paid today but only got 3 days of work and not the 2 vacation days
Am I entitled to the 2 days on vacation?
Am I entitled to the remaining PTO time?
I was never paid time time and a half for working 84 hours. I was paid 75.27 hrs 4.73 hrs out of a 8hours day off from PTO and was written a personal check for 3.75 hours of working overtime but no time and a half.
Lastly, do I qualify for unemployment?
Re: Emplyr Didn't Pay 2 Days of Pto Time After I Quit
1.) That's a matter of company policy, not law. What does the employee handbook say?
2.) This also depends on company policy. In your state, you are entitled to the payout of earned but unused vacation unless a written company policy says not.
3.) Then file a wage claim with the state DOL
4.) Probably not.
