How to Establish a Father's Paternity Following the Mother's Divorce
My question involves paternity law for the State of Georgia.
The details:
Until recently, I was married, but separated (since 2009). Divorce was finalized two days ago.
In 2013, I had a child with a man other than my husband.
Child's father not permitted to sign birth certificate.
Child has (now ex-) husband's last name.
I have restored my former last name.
We are unable to submit the Petition for Legitimation, which stipulates that "the mother was not married to another man at the time of the child's conception or birth."
Now that my divorce has been finalized, is there a way that my child's father can sign the birth certificate and my child's last name be changed?

When you divorced your husband, did you disestablish his paternity as part of the divorce judgment?

Was your husband's presumed paternity disestablished in the divorce?
You can change the child's name without much hassle - but paternity might be a different story entirely.
